Lately, US Consular Officers in Canada have been reluctant to issue H-1B visas when the applicant does not have a US or Canadian University Degree AND has never had an H-1B visa issued at his/her home Consulate. The following is an excerpt from Visa Requirements � U.S. Consular Services in Canada (http://www.consular.canada.usembassy.gov/usa_visa.asp#ability:)

Your question is not clear.
did you forget to sign the G-325A form where it says "Sign here"
OR
did you forget to write your name in native alphabet?
In first case, it will be considered improperly filed and chances are it will be rejected.
In second case, even if your native language is other than English, the person who does initial review will not know that and it will be accepted and processed.
I hope it is the second case .

Only pay for your H1 if you know employer or any of your friend has done H1 process from that employer and application was success.
You will find many scams to take H1 fees and never return your money back.
But try to find employer who is ready to file your case and in return can ask for some deposit money for security purpose and same will be return to you once you start working for him.
Whether to pay or not ?
It always depends upon individual..If you think $1500 - $2000 is not big amount for H1 then yes.. pay for it if you don't have any other option.
I did the same thing.. I search for employer who can file my case but was not succeed in that so finally paid H1 fees $2000 :( ...But I guess it will be worth it.

You need to carry both passports. The VISAs on the older passport remain valid unless they were explicitly voided.

Now I have two H1Bs after transfer, literally. Am I correct? Now I am eligible to work for both the companies. Am I correct?
Hi Raja, you hve it wrong. You dont have two visas its considered as only one. You have transfered your existing VISA to another employer. An H1 transfer is just change of employer for that given visa.
So if you are working with two companies at the same times its considered illegal. But you can work partime with your existing company A, ask the company B to approach your company and work on C2C. But dont forget to update USCIS on your parttime work.

I have mis-placed my EAD. Normally I can just apply for another EAD. But, I will be travelling to India in Mid March on Advance Parole and I'm not sure if I'll get the EAD by then.
My question is, will they ask for EAD upon re-entry.
I am thinking of applying for EAD after coming back. Is there any special processing for applying for a lost EAD ?
Any advice is appreciated.
Use the same application procedure as though applying for a new EAD, but make sure you check the box where it says "replacement of lost EAD". Also, write a cover letter explaining that you need a replacement EAD. I had to go thru this just a couple of months ago and USCIS reissued the EAD within a month.

Looks like the demand data does not include the backlog at NVC. How does it work? I am not familiar with the process. Any ideas...?

EB1= 7,595 + 2,961 ( at NVC) + new applications.
EB2= 45,573 + 6,738 ( at NVC) + Huge backlog waiting in line.
EB3= 114,442 + 102,395 ( at NVC) + unknown backlog waiting in line.
*NVC stands for National Visa Center.
** Does not include service centers.
* Spillover to EB3 may not happen for several years due to a large number of EB2's waiting to submit their 485 applications.
* Even if spillover occurs, majority of them will go to EB3 Philippines (please See the NVC backlog).
* From the above, assuming no spillover to EB3-I, it would take (56,640 + 20,873)/2600=30 years.
* With spillover (lets say after 5++ years due to the pending EB2�s), it may take another 5 to 7 years to clear the EB3 backlog.

This is really stupid of USCIS to assume that we would stay in the same position for 6-7 years before they can re open the case.
I don't know the answer to your question, but I would think if you are staying at the same place with the same company shouldn't be an issue as long as you stay in the same department.
e.g. if you start in IT as an engineer and then during the GC process you change to a managerial role this should be o.k.
But it you shift from IT to sales with the same salary there would be an issue.

My opinion - Check this with a lawyer. Seems to be complicated. Not sure if there is anything against the law done by you /your company (that affects you). Thats why the need for a good lawyer to understand the details in the case. All the best!!!

I think you can safely sponser visitors visa while you are on H1B. What do you mean by working at clients place? is that place listed on your H1B application. Many times Attorney list any other state as required. I remember my attorney doing this. But still, I don't think it should matter, at the same time, I am not an attorney.

Please don't travel till you get your 485 Receipts. Recently I read in one of IV forums that someone's application was rejected because he/she travelled while his/her application was in process. Talk to your attorney before doing it.
