HI

I filed this week my N400 based on a 5 years rule;

I am a freelance book writer and a web market engeneer;
In 2005 I was let go from my job; I filed for unemployment and I traveld to Asia working part time as writer and looking for a new job and find new places to write about in my book;
the trip lasted 5 months,

I attached my taxes for the last 5 years to the application:
will CIS look at the taxes for 2005 and look at the unemployment benefits together with my international travel?

AM I in trouble when I show up for the interview? I am concerned

this is just like what people talk about IRS. I got packet in mail asking to contact immediatly field officer at local office regarding 2006 tax returns. Thinking worst, I didn't even go beyond subject line and everybody I talked or told, scared me to death. Finally, I mustered up courage to go line-by-line. Didn't understand what they were talking about and neither did the notice had my name or SSN. So left with no-choice, called IRS and found that documents were for previous resident!

Lession for me (and all) ... if you haven't done anything wrong intentially, their is nothing to be afraid about.

There is no AC21 for derivative applicants. She can join any employer at any time. AC21 comes into picture only for primary applicant. Derivatives get almost a virtual GC in terms of EAD.

I think it would be better idea to call them and find out their hours of operation. The address is usually given on the FP notice letter.

I think: We donot have a choice. We have to show up on the day and time given on FP notice. If we can't- we have to request uscis for re-scheduling.

First of all, I'm really thankful to immigrationvoice.com to create such a lovely community.

My question and your advice

I'm currently working in Company A, My first 3 years visa is going to get expire on SEP-2009.
My current company has some issues, so If I apply my extension through my company I won't get my extension for sure.

So I contacted Company B , and applied for my H1 Transfer, they filed my H1 Transfer on 04/10/2009 through normal processing. I would like to know whether I need to switch from Normal processing to Premium Processing. If yes, then what's the procedure. I really appreciate all your time and efforts in answering my questions.

If the employer agrees not to revoke the 140, Can I change the employer after getting EAD. 485 application is pending but less than 180 days.


My project is getting over, and it seems hard to find a h1b job.

pls advice

I think your employer should cooperate with you by not withdrawing your I-140.

I remember someone posting on the forum that they got all their information, right from Labor certification on a CD through FOIA.

Do we need to follow any process to convert from H1 to EAD? Or just apply for jobs using EAD?

you can apply for jobs using EAD, when you join the company on the I-9 form note that you are on EAD and provide the details there.

My H1b expires Sep 2009 and can apply for extension from apr 2009 onwards(6 months ahead). If for some reasons the extension gets denied by around Jun 2009 will I have to leave the country immediately or am I valid till sep 30 2009 as per the original H1B. Is H1B transfer after the denial and before the i94 expiry date an option? Thank you.

Does it mean that if she graduates before the I-485 is approved, she cannot work? Or can she accept employment on the green card EAD even though the I-140/I-485 are pending. What will be her status during that period?

Don't mean to pick on you but on the lighter side, El Paso is in US only :D. Things would be much easier if visa could be renewed in US itself.

Why not any of the consulates in Mexico ( Juarez, nogales, el paso etc). ...

I am in the same boat. My wife 485 just got filed with me as dependent so I am holding off on sending mine in. I read that this is a very gray area, and at least fragomen claims that they have had cases in which both 485 applications were rejected because of this dual filing.

Check with a lawyer before you do anything.
