I received the below advice from an attorney in another forum.
"Make the CIS aware of your approved I-130 and ask that they approve your AOS on that basis. Send a copy of the I-130 approval notice, together with a copy of the I-485 receipt notice to the correspondence address shown on the lower left side of the receipt notice."
According to that attorney, it looks like I can interfile I-140 with I-130. Any thoughts/comments on this?

Dallas-Fort Worth Immigration Lawyer Has Just Posted the Following:
For the second time, a federal judge has declared a Farmers Branch ordinance banning illegal immigrants from renting in the city to be unconstitutional. U.S. District Judge Jane Boyle of Dallas ruled Wednesday that the ordinance was an attempt to enforce U.S. immigration laws – something the judge said only the federal government can do.
The judge also issued a permanent injunction to stop Farmers Branch from enforcing Ordinance 2952.
Mayor Tim O'Hare, the driving force behind the ordinances, said he wants to appeal.
"The American people are tired of judges legislating from the bench," he said. "This decision is not unexpected but welcomed, because it allows us to get closer to this ordinance becoming reality."
But O'Hare said the City Council would have to vote on whether to continue a fight that has cost the city nearly $3.2 million since September 2006. And the city may need to spend an additional $623,000 in legal fees in the year ahead, city finance director Charles Cox said Wednesday.

For all RIR cases, they have gone through March 28, 2005 at least one iterations...They also have been approving cases randomly...
For TR it is still not clear.....They have started posting the jobs in america's job bank...
So it could be anything now...There is no set pattern at present...
There is speculation on immigrationportal that all 2001/02 cases would get through in March april ....

You are fine, you can use AC21. You don't need to have I-140 approved to invoke AC21. You can even port your H1b to company A or you can just use your EAD. You just have to make sure that they won't withdraw your pending I-140 and properly reply to any RFE.

It is not a problem with EAD. I am on H1B. I have already received 2 temp. driving certificates. I am expecting one more temp. certificate before getting the original plastic card. The DMV officials told me that there are lot of immigrant people from India, China and Mexico. So the under-staffed dept requries more time to validate.

Hello,
My spouse will be in India next week and would be going for her H1B stamping at the Mumbai consulate. She came here on H4 and we applied for her H1B, effective 10/2007, and she has been working since Jan08 and have all her paystubs from that date. Can you share your experience in terms of questions they ask and supporting documents they request in addition to the documents that we are required to carry.

Mainly they ask for W2 , tax returns for all years, she was on h1. And you can also send your tax returns for all the other years she was on h4.

I guess I wasn't shocked when I saw this story, but I have to say it depressed me. The AP reports that Derby Line, Vermont and Stanstead, Quebec, really one town that happens to straddle a border, is now installing security gates to physically separate the community.

Nothing wrong with gates and fences. It's security measure, ... I am all for it and fine. Unlike Quebec, atleast in my America, outsiders are not frowned upon. Nor denied help just becaue you cannot speak their language (French). Take away from my last trip to Quebec (Quebec City) is, they don't like to see us in their part of world, nor do we welcome them.

My understanding is that USCIS pre-adjudicates every application and requests fingerprint/namecheck, even if the dates are not current. It is done to weed out denials right away - you don't need to wait for PD to become current to be denied.

Today, My H1B transfer got denied and waiting for denial notice. Employer is planning to appeal on denial case. (I am assuming that "Denial could be becasue of client letter was not furnished)
My Layer: Employer->Company A-> Primary Vendor -> Client
My I-94 is valid Nov-09-2009 based on previous employer petition. Previous employer notified USCIS on H1B termination.
On this, What would be best option.
1. File a new H1B case thru current employer (while is waiting for appeal result, as a back up plan)?
2. can I continue work for current employer since my I-94 is valid till 11/09/2009 and filling MTR?
3. Apply for H1B transfer thru primary vendor's sister concern?

07/06/2007: Hard Working Women and Men in USCIS Behind the Visa Number Fiasco
From the information available thus far, this reporter believes that no one in the agencies intended to bring about this fiasco. It was lack of close communication and coordination between the USCIS and the DOS and more or less a poor handling of the situation at some level within the USCIS. The people should remember that there are many and many women and men in the agency involved who worked hard just like you and me to do the given jobs, including managers, supervisors, and other higher ups. The agencies should take this fiasco as a good opportunity to learn a lesson on what could go wrong in the management of immigration services and responsibilities affecting hundreds and thousands of other human beings. This reporter has been visiting the field offices, particularly Nebraska Service Center and other local field offices, almost every single year for over past 20 years and have met the "human" faces of hard working officers and other workers working in tiny cubicles and facilities that cannot be described as fancy offices but more or less factories and plants. When I report the current news, this reporter sees the faces of the women and men that I have met who worked in the not necessarily fit office space and environment. Without doubt, the current fiasco should be one way or another corrected and prevented in the future. However, the people should not take this opportunity to dehumanize the current event and easily demonize other people with no faces. Probably this is the time when these women and men need most an emotional support and boost from their invisible customers. After all, things will go through the legal process or other processes to correct the mistake. Low morale of these women and men will help no purposes and causes. On behalf of our readers, we want to send a big "CHEER UP" to these women and men!

Conrad 30 program is up for extension on march 6.
According to shusterman.com although the extension is gonna take place, they plan to make physicians exempt from employment based category as long as they work in medically underserved areas....
If this bill includes the physician clause that will be a lifesaver for a lot of people and also help in visa retrogression albeit little bit.
Hope it passes....any thoughts anyone?
Yes Conrad 30 will be extended. Whenever there is lobby behind something it will get passed. There are lot of congressmen from rural America where doctors don't like to serve. So Conrad 30 helps to get doctors there.
Conrad 30 issues is same like the Amtrak issue. Every year Amtrak runs a loss and congress huff and puff abut it but eventually pass the Amtrak budget payment.
Because Amtrak threatens to stop the unprofitable routes (typical rural areas)
and a lot of Congressmen panic and pass that.

My Case:
Company A applied for GC citing future employment.
Got the EAD.
Currently I am in the pay roll of Company B(sister concern of A) in H1.
What are the things I have to do if I have to work in EAD? Can I use AC21 and move on? Do I have to work for Company A atleast for sometime?

Yes, I contacted them several times. They only ask you to wait more.
I also have sent two emails to DHS, CIS Ombudsman's office. They asked me to use a Form 7001.
I sent the Form 7001 to CIS Ombudsman on Nov/07. I didn't even get a receipt confirmation from Ombudsman's office.
I was able to open a service request after 5 months of waiting, on Dec/07. I'm still waiting for a reply about the SR.
I faxed a letter to the service center.
Nothing so far.
It's seems like the package got lost (as well as my lawyer :p ).
I just wanted to show you that there is more people in the same situation from July.

I am planning to file Labor in EB2. My Attorney sent job requirement which needs Master's + 1 year experience. But my current salary is almost 20k less than prevailing wage (level 4) for senior software engineer. But currently my salary equivalent to wage level 2.
I think i may get query at i140 , But Lawyer suggested Employer would need to be able to demonstrate their ability to pay the difference between actual salary and the prevailing wage at the time of the I-140 filing .
I am unable to get clear picture on wage levels. If i mention Level 2 , will this qualify for EB2?
Any suggestions on this.

You should be drawing enough pay check to file under EB2 as of prevaling wage.Becareful..lot of screening is going on in PERM..
