Hi
My parents Staying currently at Dubai and I wants to invite them USA. First of all, is it good idea to call them directly from UAE? or better schedule interview in India and then bring them USA.
Where can I find visitor Visa documents details?
Thanks,

I think it is apparent that people on this forum are frustrated with media representation and lack of understanding of the problems that our group, and those that we represent, face.
Without wishing to get into general political debates, it is probably a fair assumption that American citizens who are actively part of grassroots activism would be concerned about our situation if they knew about it.
There is a voice in numbers, and I believe it might be a good idea to reach out to organizations such as www.indymedia.com (http://www.indymedia.org/en/index.shtml). This is a main hub, there are various regional versions of the organization.
Just another thought on how to publicize our issues.

Hi there,
I got my FP done yesterday in Newark,NJ ASC. But online status only shows LUD on I-485 case.. I've applied EAD and AP too, but don't see LUD on them.
Also, in ASC they give you form to fillout, I only put my I-485 receipt number on it, should I have put all three receipt numbers?.
Any thoughts,
Thanks,

Hi
first labor approved in may 2006 under EB3
140 was approved in 2007
Since I already had masters before I joined the company
EB2 labor applied and received approval in Jan 2011
My attorney applied for 140 porting but received priority date as Jan 2011 instead of may 2006. My attorney says immigrations has made a mistake, attorney contacted them and received a reference number basically asking attorney to call back on Jun 1st. I'm concerned on what went wrong and what could be the worst case scenario. How much time are talking about here.
Any information will be greatly appreciated.
Thanks
It will alright, wait for few more weeks till attorney fixes the issue.

Dear Friends,
My PD (EB3)is Dec-02. I have gone for Finger Printing twice now.
I see lot of reference to '45 Day letter' in the forum . I have no recollection of receiving the '45 Day ' letter so far.
Am I missing something here?
Can any one of you please explain what this letter is about?
Thanks,
Sreekanth

Its hard to believe that she represents California... This is just adding insulst to injury...
We should investigate any 527 orgs that are against her and get their help to run advertisements which highlight her bias agaist educated people.
We have to keep stressing how anti-education, anti-hi tech she is.

Considering the state of the economy and considering that the most important poisiton to save is that of the primary applicant, I suggest that USCIS process cases of primary applicants asap.
Family members can contnue on EAD for long time; however if the principal applicant loses job and can not find another one, the entire family is done - pack bags and leave.
What do you think?

"THIS IS NOT A COMPLEX SITUATION" - Consider changing the subject.
Absolutely, she can go for stamping in India with your H1B approval and get it stamped. If she were in US, based on your H1B approval she will get an Dependent approval notice and a new I-94, she still needs H4 visa to travel.
If you file for H1B renewal in regular process it might take more time, so if you are in a hurry then go for Premium.

I think any non-H1 (including H4) stay wont count. You will have full 6 yrs on H1 visa.
Hi,
I am currently in L1B visa , i am in US for 40 Months. The total period that i can be in US in L1B is 5 yrs .
I am planning to do my H1B this year (2008), having already elapsed 40 months, if i get a H1B will the period elapsed ( 40 months in L1B) be accounted or i will get the H1b for 3 yrs.
Thanks

Remember its your responsibility to turn in I94s. No one is going to ask you these when you depart the US. Submitting the i94s and using the us visit system enable correct traclking of your entry/departures. Read the instructions on the 1797 it tells you clearly what you need to do.

What do you mean by filing ?
Is there anything to file for AC21 ? I somehow thought it's implicit and you just have to let USCIS know that you have changed your job. That's all. That too is not a mandatory task but most lawyers suggest it to play safe. I think it's matter of sending the letter with details to USCIS.
You just be prepared to explain at the 485 interview or reply to RFE's or NOID's if sent by USCIS, which wont happen till your 485 date is current or your sponsoring employer withdraws 140.

Is she studying for nursing boards or in nursing school?
If you have foreign degree then there are several steps, I think it involves CGFNS, visa screen, nclex, etc. CGFNS will take care of setting equivalency and authenticity of degree. I don't think there is need of wes evaluation, I could be wrong. Go to Carl Shustermann website and it explains in detail. Just google it.
I am also studying for boards right now, I passed my BSN from nursing school here.

I value the contribution of IV a lot, but saying that you will get an answer only if you contribute is lame.. This is a public forum and all contributions are voluntary. Your answer degrades the noble cause of IV.
An answer will magically appear after you have contributed to the IV cause.

clarify21: If you would like to maintain the H1B status, for the part time job, you will have to ask your part time employer to do the new H1B; by having two H1Bs you can work for two employers the same time.
Can you do this?, am not so sure that you can have 2 H1B's and work for both. Don't you transfer your h1 to the new employer?
I am sure clarify can use the EAD for the both full and part time job.

Thanks Reddy.
CasinoRoyale,
My question exactly, There are so many so called consulting company which might do it for a cost, but is it legal.
Reddy, says yes. Anyone else?
Consulting company doing it for a cost? Sorry, I did not understand. Why do we need consulting company? What costs?
Any legitimate company should be able to port the PD from an approved I-140 as long as it is allowed.

I am on H1B visa. Can I trade in Forex using FOREX or any other online broker?
Yes, one can trade on H-1B status, but can not claim trader status for tax filing. For more details on trader status for tax filing, contact your CPA.
Also, I need to trade in it multiple times on a single day. That's the nature of this business if you want to make money.
correction. I would say this -
That's the nature of this business if you want to make or lose money.
Good Luck.
